Đề nghị cho biết, trong văn bản về kết quả hòa giải thương mại thành cần phải có chữ ký của hòa giải viên thương mại hay không? Pháp luật quy định về các nội dung chính của văn bản về kết quả hòa giải thương mại thành như thế nào?

Văn phòng Luật sư Tô Đình Huy trả lời: Khoản 2 và khoản 3 Điều 15 Nghị định số 22/2017/NĐ-CP quy định như sau:

1. Nội dung chính của văn bản về kết quả hòa giải thành gồm:

- Căn cứ tiến hành hòa giải: như thỏa thuận hòa giải thương mại; hợp đồng thương mại có nội dung về lựa chọn phương thức giải quyết tranh chấp bằng hòa giải thương mại...

- Thông tin cơ bản về các bên.

- Nội dung chủ yếu của vụ việc.

- Thỏa thuận đạt được và giải pháp thực hiện.

- Các nội dung khác theo thỏa thuận của các bên phù hợp với quy định của pháp luật.

2. Văn bản về kết quả hòa giải thành có chữ ký của các bên và hòa giải viên thương mại.
